How is spousal support calculated?
Spousal support is typically calculated using the Spousal Support Advisory Guidelines (SSAGs), which set ranges for amount and duration based on the length of the relationship, both parties' incomes, and child support obligations. Courts use these as a starting point but retain discretion.
How long does spousal support last?
Duration depends on the length of the marriage and the circumstances of the recipient. Short marriages may result in time-limited support, while long marriages or those involving significant role changes may result in indefinite support. The SSAGs provide ranges, but courts decide based on all the facts.
Can spousal support be changed after an order is made?
Yes. Either party can apply to vary a spousal support order if there has been a material change in circumstances, such as a significant change in income, retirement, or the recipient becoming self-sufficient.
What if my ex doesn't pay support?
The Family Responsibility Office (FRO) enforces spousal support orders through wage garnishment, licence suspension, and other enforcement mechanisms. We can also bring contempt proceedings if necessary.
Does remarriage end spousal support?
